Le novitá dal congresso di
diritto canonico tenuto fra 1-8 sett. 2001 a Budapest al tema "La teritorialitá
e la personalitá nel diritto delle chiese
V prvním
zářijovém týdnu tohoto roku se v Budapešti konal jedenáctý kongres mezinárodní organizace Consociatio Internationalis Studio Iuris Canonici Promovendo se
sídlem v Římě. Byl současně kongresem organizace Society for the Law of the Eastern Churches, v jejím případě však
již patnáctým. Obě tyto organizace pořádají mezinárodní kongresy jednou za tři
roky. Poslední zasedání se konala v Lublinu (1995) a v Pamploně (1998).
Patronem letošního památného zasedání byla staroslavná katolická univerzita Pázmány Péter Katolikus Egytem v
Budapešti.
Mezi 184
účastníky převažovali zástupci Itálie, Španělska a Latinské Ameriky, početná
byla též účast delegátů z Německa, Polska, Rakouska, Švýcarska a Francie, po
několika zástupcích vyslaly univerzity z USA, Kanady, Belgie, Portugalska,
Řecka a Indie. Českou vědu zastoupili
Prof. Dr. Edward Górecki (CMTF UP Olomouc/PTF Wrocław), ThLic. Damián Němec (PF UP Olomouc), Doc. JUDr. Jiří Rajmund Tretera a Mgr. Záboj Horák LL.M. (oba PF UK
Praha). Jednacími jazyky byla angličtina, němčina, italština a španělština,
simultánní překlad do těchto jazyků byl zajištěn. Důraz byl kladen nejen na
právo latinské církve a katolicko-východních církví, ale i na kanonické právo
pravoslavné. Proto mezi přednášejícími byli také Prof. Spyridon Troianos z Athén a vladyka Pantaleimon Rodopoulos ze Soluně.
Kongres
zahrnoval celkem 20 přednášek, které probíhaly od neděle 2. 9. do pátku 7. 9. v
hotelu Hélia. V souvislosti s návštěvou fakulty humanitních věd Pázmányho
univerzity v Piliscsabě a hrobů maďarských
primasů v ostřihomské katedrále jsme spolu s ostatními účastníky kongresu
navštívili též srbsko-pravoslavné biskupství a muzeum v městečku Szentendre.
Během jednání
proběhly volby řídících orgánů Konsociace. Ve funkci presidenta Konsociace
vystřídal profesora Giorgio Felicianiho
z Milána na příští volební období jeho kolega Prof. Cesare Mirabelli z Říma.
Během konference
byla dohodnuta bližší spolupráce s Teologickou fakultou Univerzity ve
švýcarském Luzernu, kterou nám nabídl její děkan Prof. Dr.iur.can. et Lic.theol. Adrian Loretan, vedoucí katedry
církevního práva a konfesního práva. Jde především o účast na výzkumu a
zpracování problematiky
"Staatskirchenrechtliche Kontexte der Theologischen Fakultäten in den
verschieden Ländern Europas."
Prof. Alberto de la Hera, vedoucí odboru kultu na
ministerstva spravedlnosti v Madridu, vyjádřil radost, že jsme mu již dříve na
jeho žádost zaslali překlad našeho konfesněprávního zákonodárství, a dohodl
další spolupráci našeho Institutu konfesního práva s jeho institucí. Úzkou
spolupráci nám na samém počátku jednání nabídl Prof. Carlos Valderrama z Institutu církevního práva v Limě.

The Report
on the Congress of Canon Law on the Theme "Territoriality and Personality in
Canon and Church Law in Budapest
In the first
week of the September of this year, the eleventh
congress of the international
organization Consociatio Internationalis
Studio Iuris Canonici Promovendo, resided in Rome. This congress was
simultaneously the fiveteenth congress of the organization The Society for the Law of
the Eastern Churches. Both the organizations arranged international
congresses once three years. Their last conventions was hold in Lublin (1995)
and in Pamplona (1998). Now the congress was hold at the famous Catholic
University Pázmány Péter Katolikus Egytem in
Budapest.
The
representatives of Italy, Spain and Latin America prevailed among 184
participants; the delegations from Germany, Poland, Austria, Switzerland and
France were also numerous. Some delegates represented the universities from the
USA, Canada, Belgium, Portugal, Greece and India. Prof. Dr. Edward Górecki from Cyril-Method Theological Faculty of
Palacký University in Olomouc, ThLic.
Damián Němec from the Law Faculty of Palacký University and Doc. JUDr. Jiří Rajmund Tretera and Mgr. Záboj Horák LL.M., both from the
Law Faculty of Charles University, represented the Czech science. The languages
of the congress were English, German, Italian, Spanish; a simultaneous
translation into these languages was arranged. Not only the law of the Latin
Church or of the Eastern Catholic Churches, but also the Orthodox canon law
were discussed. Therefore Prof. Spyridon
Troianos from Athens and vladyka Pantaleimon
Rodopoulos from Thessaloniké presented their papers.
The congress was
contained from 20 papers which were hold from the Sunday, September 2 to the
Friday, September 7 at the Hélia Hotel. During that time we visited also to the
Faculty of Humanities of Pázmány University in Piliscsaba, the graves of the Hungarian primates in Ostřihom
Cathedral and the Serbian-Orthodox Bishopric and Museum in the town Szentendre.
During the
congress the bodies of the Consociatio were elected. Prof. Cesare Mirabelli from Rome was elected the new president of
Concociatio after Prof. Giorgio
Feliciani from Milano.
During the
congress we agreed a closer cooperation with the Theological Faculty in Luzern,
Switzerland, which was offered by the dean of this university and the chief of
the department of church law and state ecclesiastical law Prof. Dr.iur.can. et Lic.theol. Adrian Loretan. It was especially
about participation in the research and elaboration of the problematics "Staatskirchenrechtliche Kontexte der
Theologischen Fakultäten in den verschieden Ländern Europas."
Prof. Alberto de la Hera, the chief of the
department of cult at the Ministry of Justice in Madrid, expressed his pleasure
that we had sent him the translation of our state ecclesiastiacal legislative,
which he asked for. We agreed other cooperation of our Institute for State
Ecclesiastical Law with his institution. Prof.
Carlos Valderrama from the Institute of Church Law in Lima offered a closer
cooperation with his Institute too.
L´informazione dal congresso di diritto delle chiese (1 - 8 sett. 2001
a Budapest) sul tema "La teritorialitá e la personalitá nel diritto delle
chiese"
Nei primi del settembre si é svolto a Budapest XIo congresso della Consociatio Internationalis Studio Iuris Canonici Promovendo, una organizzazione internazionale con la sede a Roma. Si considerava anche il congresso della Society for the Law of the Eastern Churches, la societá cooperante con la prima, ma in questo senso si trattava del XVo congresso. Entrambe le organizzazioni svolgono i loro congressi ogni tre anni e le ultime sedute erano ospitate a Lublin (Polonia, 1995) e a Pamplona (Spagna, 1998). Il patroncinio di questa seduta era l´antica universitá cattolica di Budapest, Pázmány Péter Katolikus Egytem.
Il tema del congresso era "La teritorialitá e la personalitá nel diritto delle chiese". Fra 184 partecipanti prevalevano i rappresentanti d´Italia, Spagna e dell´America Latina, ma ci partecipavano anche numerosi delegazioni da Germagna, Polonia, Austria, Svizzera e Francia. Alcuni rappresentanti erano mandati dalle universitá degli Stati Uniti, Canada, Belgio, Portogallo, Grecia e India. La scienza ceca presentavano Prof. Dr. Edward Górecki (CMTF UP Olomouc, PTF Wroclaw), ThLic. Damián Němec (PF UP Olomouc), Doc. JUDr. Jiří R. Tretera e Mgr. Záboj Horák LL.M. (PF UK Praha). Le lingue ufficiali erano: l´inglese, il tedesco l´italiano e lo spagnolo, le traduzioni simultanee in queste lingue era disponibile. L´attenzione si concentrava non solo al diritto canonico della chiesa latine e chiese cattoliche orientali, ma anche al diritto canonico ortodosso. Per questo motivo fra i lettori c´era anche prof. Spyridon Troianos da Athene e rev. Pantaleimon Rodopoulos da Thessalonike.
Il congresso conteneva 20 lezioni tenute da domenica il 2 a venerdí il 7 sett. nell´albergo Hélia. In occasione della nostra visita alla facoltá degli studi humanistici dell´Universitá Pazmany a Piliscsaba e delle tombe degli primati ungheresi nella Cattedrale di Estergom, abbiamo anche visitato il vescovato serbo-ortodosso e il museo a Szentendre.
Durante le lezioni sono state effettuate le elezioni degli organi dirigenti della Consociatio. Al prof. Giorgio Feliciani di Milano é succeduto un suo collega, prof. Cesare Mirabelli di Roma.
Durante la conferenza ci siamo messi d´accordo con il decano della Facoltá Teologica dell´Universita di Luzern Prof. Dr.iur.can. et Lic.theol. Adrian Loretan, alla piú stretta collaborazione. Si tratta in prima fila della partecipazione alla ricerce e elaborazione della problematica "Staatskirchenrechtliche Kontexte der Theologischen Fakultäten in den verschieden Ländern Europas."
Prof. Alberto de la Hera, il direttore del dipartimento del culto al ministero di giustizia a Madrid, ha espresso la sua gioia dal sommario delle nostre norme del diritto ecclesiastico statale e abbiamo concordato l´altra collaborazione del nosto Istituto per il diritto ecclesiastico statale con la sua istituzione. Della collaborazione con noi é stato dall´inizio interessato il Prof. Carlos Valderrama dall´Istituto di diritto delle chiese a Lima.
